TERMS OF USE

1. Parties and Acceptance

This Terms of Use Agreement ("Agreement") is entered into by and between Softwate Bilişim ve Proje Yönetimi Ltd. Şti. ("Service Provider"), operating the s3w.net service ("Service"), and any individual or entity accessing or using the Service ("User"). By creating any shortened link or otherwise utilizing the s3w.net infrastructure, the User unequivocally accepts and agrees to be bound by all the terms and conditions outlined in this Agreement.

2. Description of Service and Hosting Provider Status

s3w.net is an automated utility that converts long URLs into shorter, manageable URLs. The Service Provider acts strictly as an intermediary "Hosting Provider" (or equivalent safe-harbor status under applicable digital communications laws). s3w.net does not generate, moderate, endorse, or exercise any ownership or editorial control over the contents of the destination URLs created by Users.

3. User Responsibilities and Strict Prohibitions

The User is 100% solely and exclusively responsible for the content, legality, and safety of the destination (original) URL to which their shortened link redirects. The following activities and content types are strictly prohibited on the Service:

Malware and Phishing: Generating links that redirect to malicious software, viruses, or fraudulent pages designed to steal personal, financial, or credential data.

Spam: Using the Service infrastructure to mask URLs for unsolicited email (UCE/UBE), SMS, or social media spam campaigns.

Illegal Content: Redirecting to content that promotes terrorism, child exploitation materials, copyright infringement (piracy), illegal drug or weapon sales, or any other content that violates applicable local or international laws.

System Abuse: Utilizing automated bots to bypass API limits, or conducting DDoS, load testing, or other disruptive attacks against the Service infrastructure.

4. Limitation of Liability and Indemnification

Under no circumstances shall the Service Provider (Softwate Bilişim ve Proje Yönetimi Ltd. Şti.) be held liable for the legality, accuracy, or safety of the content redirected by User-generated links.

The User is the sole liable party for any material or moral damages incurred by third parties, organizations, or security entities (such as WAFs, blacklist providers) resulting from the User's prohibited activities.

The User agrees to fully indemnify, defend, and hold harmless the Service Provider from and against any and all claims, penalties, liabilities, legal fees, and court costs arising directly or indirectly from the User's creation or distribution of links via s3w.net.

5. Sanctions and Enforcement Rights

The Service Provider reserves the right, without prior notice and without any liability for compensation, to:

Immediately delete, disable, or redirect (e.g., sinkhole / HTTP 403 Forbidden) any link suspected of abuse or reported for malicious activity.

Permanently ban IP addresses, IP blocks, or specific geographic regions from accessing the Service.

Share all digital footprints of the offending User (including IP addresses, timestamps, and routing data) with law enforcement agencies, courts, or authorized cybersecurity organizations upon legal request or to protect the integrity of the Service.

KULLANIM KOŞULLARI

1. Taraflar ve Kabul

Bu Kullanım Koşulları sözleşmesi ("Sözleşme"), s3w.net hizmetini ("Hizmet") sunan Softwate Bilişim ve Proje Yönetimi Ltd. Şti. ("Hizmet Sağlayıcı") ile Hizmet'e erişen veya kullanan kişi veya kurum ("Kullanıcı") arasında akdedilmiştir. Kullanıcı, s3w.net üzerinden herhangi bir bağlantı oluşturarak veya altyapıyı kullanarak bu sözleşmenin tüm şartlarını kayıtsız şartsız kabul etmiş sayılır.

2. Hizmetin Tanımı ve Yer Sağlayıcılık Statüsü

s3w.net, uzun URL'leri daha kısa ve yönetilebilir URL'lere dönüştüren otomatik bir yönlendirme aracıdır. Hizmet Sağlayıcı, ilgili yasal düzenlemeler kapsamında yalnızca aracı "Yer Sağlayıcı" statüsündedir. s3w.net, kullanıcılar tarafından oluşturulan kısaltılmış bağlantıların hedefindeki içerikleri üretmez, denetlemez, onaylamaz ve bu içerikler üzerinde hiçbir mülkiyet veya editoryal kontrol hakkına sahip değildir.

3. Kullanıcı Sorumlulukları ve Kesin Yasaklar

Kullanıcı, oluşturduğu her bir kısa bağlantının yönlendirdiği hedef (orijinal) URL'nin içeriğinden, yasallığından ve güvenliğinden %100 oranında, tek başına ve münhasıran sorumludur. Aşağıdaki eylemler ve içerik türleri sistem üzerinde kesinlikle yasaktır:

Kötü Amaçlı Yazılım (Malware) ve Oltalama (Phishing): Kullanıcıların cihazlarına zarar veren yazılımlara, virüslere veya kişisel/finansal verileri çalmayı amaçlayan sahte sayfalara yönlendiren bağlantılar oluşturmak.

Spam: İstenmeyen e-posta (UCE/UBE), SMS veya sosyal medya spam kampanyaları için Hizmet altyapısını bir maskeleme aracı olarak kullanmak.

Yasa Dışı İçerik: Terör propagandası, çocuk istismarı materyalleri, telif hakkı ihlali (korsan yazılım/medya), yasa dışı uyuşturucu veya silah ticareti ile yerel veya uluslararası yasalara aykırı diğer her türlü içeriğe yönlendirme yapmak.

Sistem Suistimali: Hizmeti otomatik botlar aracılığıyla API limitlerini aşacak şekilde kullanmak veya altyapıya yönelik DDoS, yük testi vb. yıkıcı saldırılar düzenlemek.

4. Sorumluluğun Sınırlandırılması ve Reddi (Limitation of Liability)

Hizmet Sağlayıcı (Softwate Bilişim ve Proje Yönetimi Ltd. Şti.), Kullanıcı tarafından oluşturulan bağlantıların yönlendirdiği içeriklerin yasallığından, doğruluğundan veya güvenilirliğinden hiçbir koşulda sorumlu tutulamaz.

Kullanıcının yasaklı eylemleri sonucunda üçüncü şahısların, kurumların veya güvenlik şirketlerinin (WAF, Blacklist sağlayıcıları vb.) uğrayacağı maddi/manevi zararların tek muhatabı bağlantıyı oluşturan Kullanıcıdır.

Kullanıcı, kendi oluşturduğu bağlantılar nedeniyle Hizmet Sağlayıcı'ya yöneltilebilecek her türlü yasal talebi, cezayı, mahkeme masrafını ve avukatlık ücretini ilk talepte nakden ve defaten tazmin etmeyi (Indemnification) peşinen kabul eder.

5. Yaptırımlar ve İhlal Durumunda Haklar

Hizmet Sağlayıcı, önceden haber vermeksizin ve herhangi bir tazminat yükümlülüğü olmaksızın şu hakları saklı tutar:

Kötüye kullanım (abuse) şüphesi taşıyan veya zararlı faaliyet rapor edilen bağlantıları derhal silmek, devre dışı bırakmak veya erişime kapatmak (örn. sinkhole / HTTP 403 yönlendirmesi).

İhlal yapan IP adreslerini, IP bloklarını veya belirli coğrafi konumları Hizmet'ten kalıcı olarak engellemek.

Resmi makamlar, mahkemeler veya yetkili siber güvenlik kuruluşları tarafından talep edilmesi veya Hizmet'in bütünlüğünün korunması amacıyla, ihlal yapan Kullanıcıya ait tüm dijital izleri (IP adresi, zaman damgası vb.) adli mercilerle paylaşmak.

PRIVACY POLICY

1. Data Collection and Processing

To ensure the security of the s3w.net service and prevent system abuse, the following minimal operational data is automatically collected in our server logs and databases when you use the Service:

The original (destination) URL submitted for shortening.

The public IP address of the device performing the request.

The timestamp (date and time) of the link creation.

User-Agent information (browser and operating system details).

(If applicable) Anonymized click statistics, referrer data, and access IP addresses of visitors who click on the shortened links.

2. Purpose of Data Collection

The collected data is processed exclusively for the following purposes:

Technical execution of the URL shortening and redirection service.

Detection, prevention, and mitigation of malicious activities such as phishing, spam, and malware, including real-time integration with autonomous security APIs (e.g., Google Safe Browsing, VirusTotal).

Measurement of system performance and infrastructure optimization.

3. Data Sharing and Disclosure (Crucial Provision)

Softwate Bilişim ve Proje Yönetimi Ltd. Şti. does not sell User data to third parties for marketing or advertising purposes. However, to prevent illegal activities and protect our network reputation, the User acknowledges and agrees that their data may be shared without restriction under the following circumstances:

Cases of Abuse: If a shortened link is identified as being used for illegal, spam, or phishing purposes, the User's IP address, timestamp, and User-Agent details will be transparently shared with global blacklist providers, WAF administrators, and cybersecurity organizations to mitigate the threat.

Legal Obligations: Data will be disclosed to competent judicial authorities, prosecutors, or authorized administrative bodies in compliance with court orders, subpoenas, or mandatory legal requests.

4. Cookies and Tracking

The Service may use operational cookies strictly for session management, Web Application Firewall (WAF) verifications, and maintaining basic statistical data. By utilizing the Service, all users consent to the use of these necessary operational cookies.

5. Contact and Abuse Reporting

If you encounter a harmful, illegal, or copyright-infringing link generated through our system, please contact the system administrator immediately at report@s3w.net to request its permanent removal. All incoming reports are processed by our autonomous systems and management team to sever routing to malicious content promptly.

GİZLİLİK POLİTİKASI 

1. Veri Toplama ve İşleme

s3w.net hizmetinin güvenliğini sağlamak ve sistemin kötüye kullanımını engellemek amacıyla, sistemi kullandığınızda aşağıdaki asgari operasyonel veriler sunucu loglarında ve veritabanında otomatik olarak toplanır:

Kısaltılmak üzere sisteme girilen orijinal (hedef) URL.

İşlemi gerçekleştiren cihaza ait açık IP adresi.

Bağlantının oluşturulma tarihi ve zaman damgası (Timestamp).

Kullanıcı Aracı (User-Agent) bilgisi (Tarayıcı ve İşletim Sistemi detayları).

(Varsa) Kısaltılan bağlantıya tıklayan ziyaretçilerin anonimleştirilmiş tıklama istatistikleri, referans (referrer) bilgileri ve erişim IP adresleri.

2. Verilerin Kullanım Amacı

Toplanan veriler yalnızca aşağıdaki amaçlarla işlenir:

URL kısaltma ve yönlendirme hizmetinin teknik altyapısının çalıştırılması.

Oltalama (phishing), spam ve malware gibi kötü amaçlı faaliyetlerin tespiti, engellenmesi ve otonom güvenlik API'leri (Google Safe Browsing, VirusTotal vb.) ile eş zamanlı entegrasyonun sağlanması.

Sistem performansının ölçülmesi ve altyapı optimizasyonlarının yapılması.

3. Veri Paylaşımı ve İfşa (Önemli Hüküm)

Softwate Bilişim ve Proje Yönetimi Ltd. Şti., Kullanıcı verilerini pazarlama veya reklam amacıyla üçüncü şahıslara kesinlikle satmaz. Ancak Kullanıcı, yasa dışı faaliyetlerin önlenmesi ve sistem itibarının korunması amacıyla aşağıdaki durumlarda verilerinin herhangi bir kısıtlama olmaksızın paylaşılabileceğini peşinen kabul eder:

Kötüye Kullanım (Abuse) Durumları: Kısaltılan bir bağlantının yasa dışı faaliyetler, spam veya oltalama (phishing) amacıyla kullanıldığının tespit edilmesi halinde; Kullanıcının IP adresi, zaman damgası ve User-Agent bilgileri tehdidi bertaraf etmek amacıyla global kara liste sağlayıcıları, WAF yöneticileri ve siber güvenlik kuruluşları ile şeffaf bir biçimde paylaşılacaktır.

Yasal Zorunluluklar: Mahkeme kararları, savcılık talepleri veya yetkili idari kurumların zorunlu yasal bilgi talepleri doğrultusunda veriler ilgili adli makamlarla paylaşılır.

4. Çerezler (Cookies) ve İzleme

Hizmet; yalnızca oturum yönetimi, güvenlik duvarı (WAF) doğrulamaları ve temel istatistiksel verilerin tutulması amacıyla zorunlu operasyonel çerezler kullanabilir. Sistemi kullanan herkes, bu operasyonel çerezlerin kullanımına onay vermiş sayılır.

5. İletişim ve Kötüye Kullanım Bildirimi (Abuse Report)

Sistemimiz üzerinden oluşturulmuş zararlı, yasa dışı veya telif hakkı ihlali barındıran bir bağlantı tespit etmeniz halinde, ilgili bağlantının kalıcı olarak devre dışı bırakılması için report@s3w.net adresi üzerinden sistem yöneticisi ile iletişime geçebilirsiniz. Gelen bildirimler otonom sistemlerimiz ve yönetim kadromuz tarafından işleme alınarak zararlı içeriklere giden yönlendirmeler derhal kesilecektir.
